DATA PROTECTION DECLARATION/INFORMATION

 

The purpose of this data protection statement is to provide information on what data is collected and processed in connection with applications and subsequent application procedures, for what purposes we process personal data and what rights data subjects have in this regard.

Personal data is information that relates to an identified or identifiable natural person. Particularly worthy of protection are personal data containing sensitive information (e.g. but not limited to: data on health, data on religious or political opinions or activities).

Personal data are processed in accordance with the provisions of the Federal Data Protection Act (DPA) and the Ordinance on Personal Data Protection (DPA) as well as any other data protection provisions of specific legislation. The data is treated confidentially and is not used for any purpose other than that stated in this notice.

1. Personal data: by personal data we mean all information relating to a natural person that makes it possible to identify him or her directly or indirectly (e.g. first name, surname, home address, e-mail address), that is collected autonomously by DOS Group SA or provided by you or by third parties (by way of example but not limited to: previous employer, recruitment agencies or through headhunters), or directly from publicly accessible sources (LinkedIn) in relation to information relating to your professional profile in the context of social networks of a professional nature (within the limits of this information notice). Furthermore, other personal data may be generated during the application process (e.g. by way of example but not limited to: email correspondence, interview, etc.).

In particular, DOS Group SA processes the following types of personal data:

  • personal details and contact information (e.g. but not limited to: name and surname; residential address; telephone number; email address; age; date of birth; gender; marital status; place of birth)
  • application documents (e.g. but not limited to: CV, photographs, certificates, diplomas, report cards) and information on training and continuing education courses, references, salary expectations
  • personal data communicated with a view to employment (e.g. but not limited to: OASI number, account number; number of children, etc.).

2. Data controller/processor: the data controller is Stefano Doninelli who can be contacted by post at the registered office of DOS Group SA, Via Rime 38, 6850 Mendrisio or at the e-mail address privacy@dos-group.com.

3. Purposes of the processing: the processing of personal data by DOS Group SA is aimed at the application process, in particular:

  • checking application documents and suitability for the job in question, including checking references and carrying out background checks
  • conduct of interviews and, if necessary, assessment
  • other pre-contractual practices with a view to employment (e.g. but not limited to: draft employment contract)
  • administrative activities (e.g. but not limited to: arranging interviews)
  • processing your personal data in view of further or future job offers at DOS Group SA and informing you of vacant positions that may become available in the future

4. Legal basis for processing: DOS Group SA processes your personal data in accordance with the provisions of the DPA and DPAA, as well as any other data protection provisions of specific legislation. The processing of the personal data of the person concerned is based on the free consent expressed and signed by the latter.

5. Data retention: The personal data collected is in principle retained for as long as necessary for the purpose of processing and/or for as long as there is a legal obligation to retain the data. As soon as the personal data collected by DOS Group SA is no longer required for the aforementioned processing purposes, or if a working relationship between you and DOS Group SA is no longer formalised, it shall be deleted or made anonymous. Subject to your prior agreement, application documents shall be kept by DOS Group SA for the calendar year in which they are received (it should be noted that application documents received in December shall be kept for the following calendar year) with a view to a further job offer. In the event that an employment contract is formalised between you and DOS Group SA, the application documents shall be considered as annexed to the personal data collected as an employee, to which the relative declaration on data protection for employees of DOS Group SA shall apply.

6. Communication of data: the personal data of the person concerned will not be communicated to third parties without your consent, unless this is strictly related to the application process or the finalisation of the employment relationship (by way of example, but not limited to the transmission of personal data to public social security institutions (AVS, LPP), private individuals (trustees, accountants). Should the activity of DOS Group SA require it, consent to the transmission of data abroad shall be presumed, only if the foreign State guarantees adequate and equivalent protection of personal data.

7. Rights of the data subject: to receive information as to whether DOS Group SA processes your personal data and, if so, which personal data are processed; to request the rectification, deletion or completion of inaccurate personal data concerning you; to restrict the processing or object to the processing of personal data; to revoke consent to the processing of personal data; to apply to a supervisory authority (IFDP). Please note, however, that these rights are subject to conditions and exceptions. To the extent authorised or required by law, certain requests may be refused. The exercise of rights as set out in this information notice may be exercised by written request sent to the address of the registered office of DOS Group SA, Via Rime 38, 6850 Mendrisio or to the e-mail address: privacy@dos-group.com, for the attention of the data controller, Mr Stefano Doninelli.

8. Changes: DOS Group SA reserves the right to change this privacy policy at any time and without prior notice. The updated version published on our website shall be considered valid.

In any case, DOS Group SA undertakes to process personal data and to guarantee the rights of the person concerned in accordance with the law.
